General

Data protection has a very high priority for us. In general, we proceed according to the principle of data avoidance.

Personal data

Personal data is information that reveals or can reveal the identity of the user. We treat your personal data confidentially and in accordance with the statutory data protection regulations (basic data protection regulation DSGVO). Insofar as personal data (e.g. name, address or e-mail address) is collected in this App, this is always done, as far as possible, on a voluntary basis and only if it is lawful according to Art. 6 DSGVO. We also do not pass on personal data to third parties without your express consent.

As soon as the purpose for which personal data was collected ceases to apply, further storage will only take place for as long as required by law. Afterwards your personal data will be deleted.

Collection of personal data in this App

To use this App you will be asked when you stopped smoking and how many cigarettes you smoked per day. You will also be asked for information about your cigarette brand. The legal basis is Art. 6 para. 1 b DSGVO.

All data is only stored locally on the iPhone used. Please note that when you make a backup of your iPhone, your personal data is also stored there.

The App does not access any other iPhone services (e.g. location services).

If you contact the support via e-mail, there is a voluntary option to attach debug information to the developer in the form of a text file. This text file contains the personal data mentioned above, information about the iPhone used (type and iOS version), region and language setting, as well as the calculated values displayed in the App.

Legal basis for the processing of personal data

In so far as we obtain your consent for the processing of personal data, Art. 6 para. 1 a DSGVO serves as the legal basis.

If the processing of personal data serves to fulfil a contract with you, Art. 6 para. 1 b DSGVO is applicable. This also applies to processing operations which are necessary for the implementation of pre-contractual measures.

If the processing of personal data is necessary to fulfil a legal obligation to which our company is subject, Art. 6 para. 1 c DSGVO serves as the legal basis.

In the event that vital interests of you or another natural person make it necessary to process personal data, the legal basis is Art. 6 para. 1 d DSGVO.

If the processing of personal data is necessary to protect a legitimate interest of our company or of a third party and if your interests and fundamental rights do not outweigh the former interest, Art. 6 para. 1 f DSGVO serves as the legal basis.

Your rights according to DSGVO

Right to information

In accordance with Art. 15 DSGVO, you have the right to request confirmation from us as to whether we are processing personal data about you. If this is the case, you have the right to be informed about this personal data and to receive the further information mentioned in Art. 15 DSGVO.

Right of correction

Under Art. 16 of the DPA, you have the right to correct incorrect personal data concerning you, and you may also request the completion of incomplete personal data.

Right to delete

According to Art. 17 DSGVO you have the right to request the deletion of your personal data stored by us. This applies in particular if:

  • your personal data are no longer required for the purposes for which they were collected or otherwise processed,
  • you withdraw your consent on which the processing was based and there is no other legal basis for the processing,
  • your personal data have been processed unlawfully.

You can, however, only demand the deletion of your personal data stored with us if the processing is not necessary for the exercise of the right to freedom of expression and information, for the fulfilment of a legal obligation, for reasons of public interest or for the assertion, exercise or defence of legal claims.

Right to restrict processing

Pursuant to Art. 18 DSGVO, you have the right to ask us to limit the processing of your personal data if:

  • you dispute the accuracy of the data,
  • the processing is unlawful and you refuse to delete it and instead request the restriction of use,
  • we no longer need the data, but you need it to assert, exercise or defend legal claims,
  • you have lodged an objection to the processing of your data in accordance with Art. 21 DSGVO, and it has not yet been established whether our justified reasons outweigh your reasons.

Right to data transferability

Pursuant to Art. 20 DSGVO, you have the right to receive the personal data concerning you that you have provided us with in a structured, common and machine-readable format. You also have the right to request that the data be transferred to another person responsible, provided that the processing is based on a consent or a contract in accordance with DSGVO and that the processing is carried out by us using automated procedures.

Right of objection

In accordance with Art. 21 DSGVO, you can object to the future processing of data concerning you at any time. In particular, you may object to processing for the purposes of direct advertising.

If you wish to exercise your right of objection, simply send an e-mail to the person responsible for data protection.

Right of withdrawal

Under Art. 7 Para. 3 DSGVO, you have the right to revoke any consent you have given with effect for the future.

Right to appeal to a supervisory authority

You have the right to complain to a supervisory authority in accordance with Art. 77 DSGVO. As a rule, you can contact the supervisory authority of your usual place of residence or work or the place of the suspected infringement.

E-Mail contact

Any contact can be established via the provided e-mail address. In this case, your personal data transmitted with the e-mail will be stored, which allows us to process your contact.

The legal basis for the processing of data transmitted in the course of sending an e-mail is Art. 6 Para. 1 lit. f DSGVO. If the e-mail contact is aimed at the conclusion of a contract, Art. 6 para. 1 b DSGVO is also the legal basis.

Third-party content and services

We take the protection of your personal data very seriously and deliberately do not include content or service offers from third parties.

Data Security

We use suitable technical and organizational security measures to protect your data against manipulation, loss, destruction or unauthorized access by third parties.

However, we would like to point out that data transmission over the Internet (e.g. communication by e-mail) may be subject to security gaps. A complete protection of personal data against access by third parties is not possible.
